Terms of Service

By accessing or using the Growth Tools Hub website (the “Site”) and any of the digital marketing, automation, and AI services we provide (the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree with any part of these Terms, you may not access or use the Site or Services.

These Terms form a legally binding agreement between you (“you,” “your,” or “Client”) and Growth Tools Hub (“we,” “us,” “our,” or “Company”).

Growth Tools Hub provides digital growth services for local businesses, including but not limited to: Google Business Profile optimization and ranking, search-engine-optimized website design and development, AI chatbot and AI receptionist lead capture, automated review and photo request systems, and automated social and Google Business Profile posting.

We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time, with or without notice. Specific deliverables, timelines, and fees for any engagement are governed by a separate service agreement or statement of work.

You represent and warrant that you are at least 18 years of age, that you have the legal authority to enter into these Terms on behalf of any business you represent, and that the information you provide to us is accurate and complete.

You are solely responsible for maintaining the confidentiality of any accounts, credentials, or access materials provided to you in connection with the Services.

To enable the Services, you agree to provide timely access to relevant accounts, platforms, assets, and information — including Google Business Profile access, website hosting or domain credentials, and any third-party tools required for integration.

You are responsible for the accuracy and legality of all content, offers, and business information you ask us to publish or promote on your behalf. You agree to respond to our requests for approval, feedback, or materials in a timely manner, as delays may affect results and timelines.

Fees for the Services are described on our pricing page and in your service agreement. Monthly base fees are billed in advance. Usage-based charges (such as email, phone numbers, text messages, voice AI minutes, conversation AI messages, reviews AI, content AI, funnel AI, and workflow AI requests) are billed based on actual consumption and are billed in arrears unless otherwise stated.

Certain tools are optional or not required for your program; optional and non-required usage will be clearly identified. An Unlimited AI add-on may be offered at a flat monthly rate after an initial calculation period to determine whether it represents better value than your actual usage.

All fees are non-refundable except where required by law. We may adjust our fees or usage rates with at least 30 days’ prior notice. Outstanding balances accrue interest and may result in suspension of Services.

All content, software, tools, templates, methodologies, and materials we create or provide remain the property of Growth Tools Hub unless expressly assigned in writing in a separate agreement.

You retain ownership of your business name, logo, brand assets, and any content you supply to us. You grant us a non-exclusive license to use, reproduce, and display your brand assets solely as needed to provide the Services.

The Services rely on third-party platforms and tools (such as Google, social media networks, telephony and messaging providers, and AI services). We are not responsible for the actions, policies, outages, or changes of these third parties, and we cannot guarantee uninterrupted access to them.

You agree to comply with the terms of service and acceptable-use policies of all third-party platforms used in connection with your engagement.

While we use proven systems and best practices to improve your online visibility, lead capture, and reputation, search engine rankings, platform algorithms, and market conditions are outside our control. We do not guarantee specific rankings, traffic volume, lead volume, or revenue outcomes.

Typical clients may see ranking movement within 60–90 days, but individual results vary and no timeframe is promised or guaranteed.

Either party may terminate the engagement in accordance with the notice period in your service agreement. Upon termination, you remain responsible for all fees incurred through the effective date of termination.

Upon termination, we will reasonably assist with transition of assets and accounts you own, subject to payment of all outstanding amounts. Pro-rated refunds, if any, are governed by your service agreement.

To the maximum extent permitted by law, Growth Tools Hub and its affiliates, officers, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunity, arising out of or related to the Services.

Our aggregate liability for any claim arising from or related to these Terms or the Services shall not exceed the total amount you paid us in the three (3) months preceding the event giving rise to the claim.

You agree to indemnify and hold harmless Growth Tools Hub from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your content, your breach of these Terms, your violation of applicable law or third-party rights, or your misuse of the Services.

Our handling of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. Material changes will be communicated through the Site or by email. Continued use of the Site or Services after changes take effect constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the jurisdiction in which Growth Tools Hub is organized, without regard to conflict-of-law principles. Any disputes will be resolved in the courts of that jurisdiction, unless we agree otherwise in writing.
